A Guest Post from Stepto Regarding Console Suspensions

Hi everyone, Stephen Toulouse here, "Stepto" on Xbox LIVE and the weekly Major Nelson Radio podcast.  Most of you know me as the head of the Policy and Enforcement team for Xbox LIVE.

As I have noted many times on the podcast, the enforcement team exists to help protect the LIVE experience. One of the ways we do that is to prevent consoles from accessing the service that are involved in bad behavior such as cheating, fraud, running unauthorized software on the service, or playing illegitimate copies of games (to name a few). For the vast majority of our actions, our team reviews a lot of data, examines the behavior, and then we take action.  In some cases, very rarely, we use software features on the Xbox itself to help us take action.

Recently, it was brought to our attention that a number of customers had concerns about the validity of a recent ban of their individual consoles, which they feel had been triggered inaccurately. In this case, the bans were related specifically to modded consoles. I take these claims very seriously, and after an initial investigation we have confirmed that a handful of banned consoles did in-fact appear to not have been modified or tampered with. We’re still conducting our review but the cause appears to be a software issue, not an error on the part of the enforcement team’s normal actions.  It’s very specific and occurred between August 29 and September 9, affecting a very small percentage of users.

One of the most serious actions my team can take is to prevent a console from accessing Xbox LIVE.  We make every effort to be conservative when taking that action. If there is any doubt that this step was taken incorrectly, we want to address it while at the same time protecting the service for our customers.

Therefore, while we are still conducting a thorough investigation, the enforcement team is taking the step of reversing the bans for the tiny set of impacted consoles in that time period. Again, while it’s an extremely small percentage of impacted consoles, the good news is that we know exactly which ones. If you believe you are affected, simply try to reconnect your console to Xbox LIVE.  If it cannot still connect, that console was not a part of this issue.

Within a few business days, we will issue the primary account holder on the impacted console a credit for three months of Xbox LIVE Gold and 1600 Microsoft points.  Since we know exactly who is affected, those customers do not need to take any action.  Everything will be applied automatically. No keys or tokens to redeem, no other action to be taken.

I’d like to take a moment to personally apologize for the inconvenience this has almost certainly caused to the affected customers. You have my assurance that we are investigating how this error occurred and have since discontinued use of the software that was used. The Xbox LIVE community is the best out there and we regret the inconvenience this may have caused for our loyal members.

    1600 MS points and 3 months Xbox gold membership for being banned for your mistakes is not much compensation.Modding is a serious issue and to be accused of it when you are clearly innocent warrants a bit more than what you are offering.Maybe try offering a new Xbox console.

    Buenas, lo primero agradecer el que pierda un poco de tiempo leyendo esto.

    Lo segundo es mostrarle mi descontento hacia el equipo de XBOX
    Live,llevo como 2 años y medio jugando a Xbox live, jugando desde el
    mismo perfil sin ningún tipo de incidencias, hasta ahora. Hace unos días
    al intentar entrar a mi cuenta, saltó un cartelito, donde se me avisaba
    de que mi cuenta había sido suspendida permanentemente, al revisar mi
    correo, leí una notificacion de vuestra parte donde se me acusaba de
    ladrón, piratería y compras ilegales y para colmo llamé al servicio
    técnico, donde una maleducada señorita, se deciso de mi como tal trapo
    viejo. Por supuesto no habiendo realizado NINGúN tipo de actividad
    ilícita, añandiendo a eso que de mis 100 amigos de XBOX LIVE, soy el
    úNICO al que le ha pasado.

    Me gustaría que se resivara mi caso, GT: Zero Haker

    Ya no es solo por la cantidad de dinero que llevo gastado en dicho
    perfil, que sera alrededor de 400€, ni por el hecho de ser fiel seguidor
    de la compañia Microsoft hasta el punto de tener 3 Xbox’s y bastantes
    complementos, sino por el cruel trato que se me ha dado asi como el
    trato a mi cuenta baneada, por un motivo no aparente y que además está
    dando tanta polémica.

    Gracias por todo, y espero que sepan portarse como es debido con un fiel seguidor como yo.

    I am submitting this post not for console suspension but just suspension in general. I simply want my voice to be heard. The so called Xbox Live enforcer team is like a Dictatorship with no leniancy. Suspending and banning without mercy. Yes it is true that there are some, actually alot of people that deserve to be suspended or banned for things said or done on xbox live. Point in fact flying in a map that you arent suppose to fly on. Or unlimited ammo, or Infinite health. Those i can see as a serious issue when it comes to playing on xbox live. And for the part where leniancy needs to come in, issues like suspending accounts or banning accounts for having a different color avatar!!!! Like Seriously!!!!!!! NOBODY CARES!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!! Or how about just because somebody pwn’s someone and they get upset and decide hey im gonna complain just to see what happens. Well more than likely you will get suspended, so my advice to you is to suck at all video games and let everyone beat you. Cause you might turn your xbox on the next day to find out that you have been suspended because some little 14 year old kid or some 35 year old british guy who still lives with his mother got angry because they got pwn’ed and decided to file a complaint. Like i said there is no leniancy. No justice in any of the decisions made by the “Enforcer Squad” if you will. I came across another example. yes this guy had put a quote in his bio and it had the F bomb in it only it was ***** out. Now To my understanding he had made his little bio nearly a year and a half ago. I dont know about you but a simple warning or notification would have sufficed. most people would completely agree and have no problem changing there Information around so as to not offend other people. Now if you wanted to suspend him for what he had put you should have suspended him a year and a half ago when he had made it. How are you going to punish someone who had probably forgot all about what he had done. Thats like rubbing a dogs nose into his dried up pee from 3 weeks ago. He has no clue why he is being punished simply because he has forgot about it. It is unjustified that honest loyal supporters of xbox who pay $60 dollars a year have no say or warning in anything that the “enforcers” do. Even if you call Xbox Live Support do you know what they will say???? They will tell you that they cannot do anything because That is a completely different branch of xbox. They might as well tell you sorry sir but we have no control over your xbox The “enforcers” do but hey if you are having connection problems call us back and then we will try to help other than that sorry your out of luck. It is things like that; that get under my skin. Like i said yes there are alot of people that deserve it, but Just because there are alot of people that deserve it doesnt mean EVERYONE DESERVES IT!!!!!!!!!!!

    My gamertag is D3athSTalk3r360 and i was recently suspended for a Bio that i had created nearly an entire year and a half ago. I think it is unjust to punish for something i had completely forgot about

    Well my gamertag is still banned and Im accused of market place theft. I have never stolen anything in my life. After countless times trying to post on the support forums asking if it could be looked at again, and after being ignored countless times as I please my innocence, it still looks as if everything is falling on deaf ears. Being a former Police Officer I dont like the fact Im being accused of being a theif and especially with no evidence forthcoming. I would again respectfully ask that someone please look into this. Pragnorok is the gamertag and after all the time and money I have spent on xbox live I would live in hope that someone sees sense. I have 5 xbox 360s 1 for myself and 1 each for my children this is so we can enjoy family gaming, yet with this profile ban we are not able to enjoy our gaming together. If  someone could please look into this I would be most grateful thankyou.

    this thread is for wrongly banned consoles. mine was wrongly banned on 2nd of September. I checked the other day after this press and it now connects. My problem is, even though i expressed i had done nothing wrong and my Xbox was not modded or tampered with,  i was told on email, twitter and telephone by the support team, that a console ban was PERMANENT and UNREVERSABLE. So i went out and bought a new Xbox. Now 3 weeks later my old xbox connects to live again. Ive wasted £200 of my hard earned money on a new Xbox because of a Microsoft error, and im not really happy with 1600 points and 3 months live “compensation” Despite being told on twitter theres a possiblity i could be offered something more as a “gesture”, im still being fobbed off on the phone support as being told there is nothing they can do. I dont expect a full £200 refund , maybe a gesture of a game code or more points. Small price to pay for one of the richest if not the richest company in the world

        you get a message when your xbox tries to log into your profile saying “this console is banned due to a breach of terms and conditions”
         
        now it doesnt, ive had an email saying mine was one of the ones affected

    My console got banned a few weeks ago so it seemed pointless to keep it..sooooooo i sold the console that they now took the ban off…i spent $200 a brand new xbox because of that ban…it says in the Microsoft forums that they basically cant undo a console ban..this is crap right now …o but dont worry cause they gave me 1600 msp to reimburse me……really….

      same boat, dude. its total bs, but what else can we do? nothing!  hopefully some more openess will come of this. it just does suck that they tell you no, there is nothing you can do to get this all reversed, so you go and get the cheapest one you can buy (because you’ve been told you are screwed)  and then a month later they are all like, ‘lol, our bad doodz. heres 40 bucks worth of junk. lulz, dont be mad at us. But hey, we arent playstaion. amirite?’

    Anyone that is complaining about the compensation is F***ing Clown Shoes… They admitted their mistake and are compensating people that were unfairly banned. That is more than most companies would do. How is 3 months Xbox Live & 1600 ms points not enough?

    You sold your console? That sounds like an admission of guilt to me. If my console was banned and I did absolutely nothing to warrent that ban I would fight until I was fairly compensated. I would not sell my console and buy a new one. Stop trying to cheat the system and you won’t have to worry about getting banned.

      you cannot fight until fairly compensated. the in no uncertain terms tell you 1) your console is banned and B) will do not discuss nor reverse console bans. Now, this is obviously a HUGE error on their part and hopefully will open some line of notification or other recourse like minor GT bans.

    These things happen. No person or system is perfect and the ‘compensation’ being offered is a nice gesture.  Thanks for being open and honest about this Stepto, as a customer it’s great to see.  For all those who are whining, I understand your frustration but *please* grow up.

    I’ve been banned for nothing. I was on holiday for the past 3 weeks (i have proof), and my xbox has been off for that time. I read the email they sent me and ive been banned for ‘marketplace theft’. I dont get it, I did nothing wrong. I hope it gets sorted out though. GT: oX PABLO Xo

      They didn’t even tell me why I was banned. It just happened. But this reimbursement is a welcome thing, it made me very pleased to see I didn’t have to buy a new xbox.

    IDK who it was that said this, but the guy that said something along the lines of ‘Microsoft needs to be more lenient, like how some people were banned for changing their avatar colors. Who cares?’.

    What a lot of people don’t seem to understand…..yea it may not be a big deal to do something like this, but fact is, IT IS a big deal! People spend months writing and working on the code for all things Xbox……the programming code used, is property of MICROSOFT, NOT YOU! Yes you bought your Xbox, you paid for it, but you do NOT own the code, you do NOT own the rights to the software! You hacked into the code to change what you changed, or to steal stuff from the marketplace, whatever. They have every right to ban you for hack into their property.

    It’s like if I came over and say, broke into your house, found your safe, and stole your social security card, and any other personal documents that are supposed to be kept confidential! Not my right, just like it’s not your right to change a couple of values in their code to change the color of an avatar, as minor as it may seem, it’s certainly a BANNABLE OFFENSE!

      also, when it originally got banned, i got told via email support, via phone support and via twitter support than a console ban was PERMANENT and UNREVERSABLE and there was nothing they could do.     Sylair..if its a console ban a message will come up when you try and log onto xbox live saying that your console has been banned..if its an account suspension the same thing will happen but ull also get an email.

    Thank you, because I really do not have to be banned do not do illegal actions, I love LIVE and would not want to lose, when I was informed of the ban, I was very sad to be an honest user, but I lost a LIVE time they had paid and not is cool, hopefully it has the compensation for both parties not having prejudices … Thanks again, I believe in Microsoft and its partners.

    Well as of reading this, right now I am still banned. I’ve contacted and complained several times to my local Xbox (Mexico) in facebook, twitter, and even mail. I’ve also called customer service by phone (which is, in fact United States phone, so the calls from my country are very expensive) And, every time I call, they treat me very bad and never give me any reason. I’ve even complained with Xbox in Spain and not received any response then. Been xbox user since the first console, and 360 live user for several years now. I’ve purchased many titles in the Arcade shop, along with DLCs and tons of original software on disc; and then, I receive this kind of treatment. I am really sad, angry and have encountered feelings about this issue. I really don’t know what to do, or with whom I need to complain. All my software is original and I have not modded or done anything to my console. To be honest with you, after this issue, I totally lost my love to play xbox. Please, I hope I could get help from you, I don’t know where else I should call or email or anything. Because I’ve never receive any feedback from Xbox sice then, not even an explanation. In fact, I have some other issues with you, I paid for a console fix like 4 months ago, they charged my credit card inmediatly and until now I’ve not received the box that I was suppose to receive for sending the console. On the website, the request still says “in progress”. So, because of this, I purchased ANOTHER console a couple of months ago, and in this new console, suddenly I GET BANNED !! WITH NO REASON !!!  I don’t think I deserve this, I’ve spent a lot of money with you, I have been a very big fan of xbox since it’s beginings… and now with this two issues I feel really dissapointed. Major Nelson, you’re a huge voice in the Xbox community, I know it will be very difficult for you to find time and help a single user, but I feel really desperate. I really need help from somebody !!     Thanks,  I’d like to think the nine hours of phone calls had some impact on getting my Xbox unbanned.  And to Amber in the NC call center, “I guess my son didn’t do anything to deserve the ban”.  That’s Amber a call center manger in the NC call center who insulted me, blamed me, and hung up on me,  and now that my box is back on I think she should be one of 400K people isted as unemployed this week.

    My husband and I were very frustrated with the call center when we were NOT told why our 11 year old son had been banned. We were told it was a privacy issue–and yet not informing parents of the exact nature of their child’s behavior makes it very difficult to address said issues. I believe parents should be alerted to their son/daughter’s behaviors–particularly when we were being told our son had done something quite heinous. He is too embarrassed about his body to be nude, too horrified by cussing to do it (turns red and stutters when others do), and too incompetent (and knows it) with computers and other electronics to even attempt modifying his console. When we were read the list of actions which would get him banned, we both knew he had not done any of those. I know, you think I’m naive…but I know my son. He was one of the people who was incorrectly banned–and is now back on. My son is ecstatic–and the free 3 months and pts are bonus for him. While my husband and I would have preferred MS did more–the real customer, my son, is quite pleased with the outcome.

    Bricking a console an inconvenience? I’m still on XBOX 1 and I got knocked off because of upgrades. It’s because of all this stuff about security and banning that I can’t throw down the money for the console and account. I thought there were no recourse. What changed? Fair is fair I guess.

      Although I see your point, the consoles were not bricked, they were barred from accessing Xbox Live. They were still able to be used offline. What you have here is not a recourse, it’s a correction to an error in the banning process. Anyone who gets truly banned will not get a recourse.

    Respect for Microsoft on this one. Console bans have always been a touchy subject, yet at least you have the balls to say “sorry, we made a mistake” when things go wrong, rather than ignoring it and hoping nobody notices (it affects a very small amount of people I heard). More than that: 1600 points. That’s a quality XBLA game and some expansions, free to choose. If I were affected, that would surely more than make up for the inconvenience :)

    When I called support I was called a thief. I said again and again that was not true. My GT was TIT00MANE & TITOMANE. Now I have no think I will have. I use xlink and leaf. If you have fiber plays well. It’s free.They are thieves who accuse others and me who lose all my months my dlc & gold.Xbox Live will never recommend anyone else.

    you Assholes banned my account for market place theft even though iv bought hundreds of dollars of dlc arcade and God’s and when i call xbox support i get hung up on (nice support team) and then i go into the forums and they aren’t giving out any detail’s on market place theft anymore. i feel like you robbed me Lol.

    I have never had an issue with the enforcement team.  But I have always felt like their enforcement policies–particularly around not having an appeal process, or even a good explanation for enforcement–were heavy handed and down right dictatorial.  XBL member for 6 years or so now, with a family account and 2 xboxes. I love the XBOX ecosystem, but we are all just a mistake away from getting it all wiped away without recourse or explanation.

    mhm perma banned my xbl account for marketplace theft even though i have no idea what i did i have spent hundreds of dollars in that account lost all my stuff and 6 months of gold and 1200 msp i called xbox support 9 times 6 times i was hung up on (great customer support Sarcasm ) then the ones that did help said they didn’t see anything wrong with my account to as why it was banned and told me to go to forums i did so posted 5 times all ignored then they posted an announcement they aren’t giving any more details on mp theft thanks for screwing me out of all that money for no reason at all.i have been told to take microsoft to court but i won’t because um im not dumb enough to go against a muti billion dollar company : |
