Glad to see Team Xbox dosen't has it head up it's ass like the rest of the entertainment industry. Hell, I might spring for the premium kit just to see what I can do with NO programming experience.

The answer to this is a definite, huge NO. For one, I am sure the code is approved by MS, and I am sure the XNA devkits will not allow those kind of actions. 

But the biggest reason is, as suggested from the words they are using, XNA runs differently from normal native coding (though it sounds like from this keynote that the performance is very comparable to native games using the Xbox 360 Development Kit), so it won't have the control over the system these hackers could do like with native coding. Thus this prevents these kind of actions from happening, and it keeps everyone's investments safe. 

So independent development/homebrew development can happen without damaging Microsoft's game business on Xbox 360, and now homebrew game devs don't have to depend on illegal hacks and/or console modifications and illegally obtained development software just to create a custom game on a platform (like some did with the original Xbox, unfortunally), and people can learn about game development and create games while doing it as well. So all sides win majorly here, and this is one extremely wise move for Microsoft. It shows one thing, they definitely care about all sides of the Gaming Community and Development Community and are engaged in it. That's why sites such as Major Nelson's blog and podcast here exist, and other Xbox developer blogs (such as GamerScoreBlog), exist, and why the Xbox developers constantly scope gaming websites.
