This is the worst thing m$ just wants to scan people and get there money for new consoles, I mean go look at their stock. The company is losing it and they want to take it out on "modders" who don't feel like paying $60 to try a game and find out if it sucks. I mean go on some of the sites that leak games everyone says "this game is good I am going to have to buy it" or "this game sucks don't even waste a disk". It is mainly for testing purposes and if M$ bans the wrong people, I feel really bad for them as some of my people have a few KV's and so long to paying for M$ points to getting your gamertag changed. I mean M$ could probably be sued for this as so many innocents were banned including one of my 4 consoles. BS.

i understand MS wanting to stop or giving a "big blow" to piracy, but just for the fact that i BOUGHT a game before release date IT'S UNFAIR to be BANNED which is the case with me

Frankly that's a stupid move, you're blaming and condemning users for something that may be the store's fault.

I can defend your move on banning pirates, I'd do the same thing. But people who get games early?

With regards to banning the modders/pirates I now agree with getting them banned as I was once one of the afore mentioned people and I learnt my lesson.

But now I have been BANNED for having 2 legitimate 360 consoles.

Basically it all started when my sons HDD failed......Its a little long for me to type it all again so here are the links for you to make your own mind up! And yes they are the same as when they left the factories apart from LIVE doesn't work anymore.

Like I have said you can all make your own minds up about this....but I am going to try and fight this as much as I can! I just can't justify spending any more money on being the owner of more legal 360's just in case this happens again!

All I can say is MS your just in it for the money....especially since its nearly Xmas and with the credit crunch....I suppose it sort of guarantees sales!

This thread is ridiculous...I make a lot of money, and have no problem spending it on legit copies of games, and I do have a Gamefly account that I use to try out games that either didn't have a demo or that just didn't look quite up to the standards I have for purchasing a retail title. You have the right, once you buy a 360, to do whatever you want with it. MS has the right to deny you access to Live (which is NOT included with a 360 (a 30 day trial is)). IF you need to change a fan, or you want to mod your case, you will NOT be banned , BUT it will void your warranty. As for the "innocent" people being banned...I am formally waving the BS flag. Oh, yes their stories sound so heartbreaking...they spent hundreds of dollars, just got their console, and now it's banned "for no reason". It's the same story, and 90% of it is some idiot who thought it would be fun to flash their 360, got caught, and whose parents won't buy them a new one so they make up a big story. For the few legit people out there who get banned, IT IS THE PIRATES FAULT. Flashed 360's slip through the MS repair process and get "refurb'd", and they love trading them in to game shops, letting someone buy it and inherit their problem (MS does extensive research before banning, and that takes time, so you might get a console that has been flashed, and was "in the system", so when you log on the ban goes to you).

You don't have to pay full price to replace a disc that gets damaged in a 360 (and if you would quit bumping it or turning it when it's running you might be surprised at how many discs DON'T get damaged), just go to xbox.com and search for the disc replacement program...they will replace your disc for a much reduced price as long as you still have the original. After the update, the answer is simple, buy a HDD! There are plenty of options out there, and even on ebay you can find 120gb drives for 70-80 bucks.

There is no excuse that makes flashing a 360 (wrong), downloading a digital copy of a copyrighted game, especially prior to a release date (wrong and double wrong), burning that copy to a disc and playing it (wrong) something you are "entitled" to do. You are breaking numerous laws (even international laws), and the lame "I'm backing up my games" is a hard sell when you are playing something 2 weeks before it comes out...and yet you wonder how you got caught??? Some of you will continue to get away with it, but like some other people said, EVERY post on this site is tracked, and all the ANON label means is that you didn't man up and register your g/t before making your idiotic flame/ fanboy/ "I'm a pirate" posts...you brainiacs are making finding you sooooo much easier!

I do think that the replacement service should be more like Sony's. I remember my PS2 died a few years back and they were excellent. It would appear MS want a good rep, hence the extension of the warranty to cover RROD for 3 years, but at the same time make the customers who have faulty 360's jump through too many hoops before replacing *known* faulty equipment.

As for backup's???? Well MS replace 1st party disc titles... It's about time they enforce 3rd party's to do this for a reasonable price... Say £5 or ~$10 (inc postage).

I disagree with piracy, but also disagree with the cashcow titles that are pushed out of the door too soon OR movie tie in's that are generic off the shelf games.

The Wii is the biggest offender of the poor title release ever... And no demo's are available which means that I guess backup loaders are the only way to sample a game before buying it.

Support MS.

They support us with a good online service.

With good demo's.

If MS could do anything, it would be to improve the hardware... I hope someone with power is listening!

Microsoft treat there customers like shite, people 360 fail after a few months and they have to wait weeks to get it fixed. My PS3 died and Sony sent a replacement the next day by courier, the courier took away the faulty one.

As far as Im concerned the 360 should have an automatic 3 year warranty covering everything cause we all know the DVD drives they use are cheap crap that fail too often.

I have some sympathy with the people who post that we should have the right to legitimately back up content. Here's the deal. I have around 15 consoles (most disk based) and have no way of backing up my investment. I have 30 legit games for my 360 and around the same for my original xbox. I have had 2 360's RROD on me and decided eventually to purchase a new one because I was getting tired of being re-shipped 06-spec repair models that kept RROD'ing. Along the way, I have had discs (only 1 or 2) scratch in the drive. That was the last (my 3rd) 360 to be returned to the repair centre as the disc drive went faulty. Nowhere along the way does anyone offer to replace any of my property that's been damaged. Guys, I love my 360 and I personally choose to purchase legitimate content. That said, I feel we should have a genuine back-up mechanism for our content.I do also think that anyone who 'interferes' with the live service should be banned.

screw the avatars..Im awaiting the silencing of the lawnmower CD drive in favor of the ability to dump titles to the HDD.. and the zero'ing out of the games with zero achievements..I cant wait to delete yaris outta there forever!

Regarding the NXE update leak, I was tempted to install it but chose not to because I didnt want to risk being banned from Live.

I dont condone game piracy as it cheats game developers of £££'s, but I hope that those who have installed the NXE update dont get banned, at the end of the day its still the official Xbox software, they're just itching to get their hands on, as i am but with less than a week to go and with no option to do what i actually want (create my avatar) i'm going to be strong and wait til the 19th.....hard though it is!!!

in closing once again on @Binarynova.. Do I also not sit well in your aspect that I PAY for a Video Game renting service like gamefly to TRY b4 I BUY??? and if i do buy it does not match the 59.99 retail price eithger. Though gamefly makes it back on me in mothly fees, Gears 2 right now has cost me 0 dollars..so what if i didnt have it at midnight on 11/7..And MS , Major & Crew..gamefly shipped it to me early. When i got the email alert physically on 11/6 should Gamefly see a ban also for an early release & shipp??

@Binarynova get some of your facts straight, if what you're saying is true then you've never rented a movie from your local store or Blockbuster or Netflix? and by going to the movies to see a release you are only adding to the box office purse, what you should then do is also buY the movie when it hits DVD & blu-ray too right??

Before I get into my take here let me comment on some of the blogs leading up to my soap box rant..I like the analogy one user previuosly up the blog here put here about getting a used car from a few years back if they cannot get a current years model release. I dont think the used car market will ever crumble because people will follow @Binarynova example.

Also another user put it to example in that video games some used have indeed better prices than that of new. Im sure if someone traded in Gears of War 2 right now!!(heaven knows why they did) it will not match a 59.99 price maybe 54 or 50 bucks depending as used..going forward a few months I see a used GOW2 dropping to 49.99 while the retail new sits still at 59.99. This is where another user made a comparison to the DVD industry not having much of an issue here being that older titles are fairly priced..

CMON MS & PS3!!! FIFA 2007 still 59.99?? oh yeah @Binarynova i will absolutely NOT look at the used rack for this one or any other old title..This is one thing that puzzled me when i came aboard on 360 in May of 2007 why dirt old titles still shrinkwrapped in plastic still retail for that of a 59.99 sticker??? Trust me video game stores have used racks for a reason and they will never be boycotted so that developers get their full coin back on a title twice? (I'm sure like actors get paid if tv shows hit re-runs, they to get percentages on title's continued sales) However, sad to say when my paycheck comes I only get paid once so until someone makes it to my benefit to get a new title from 05 as retail I'll continue to comb the used racks..

ONTO the banning of consoles for pirates...reading back here alot of you guys who stand up for ripping & CD burning of your HARD EARNED MONEY GAME DISCS for your benefit to prevent scratching & wear and tear make good points however with those goodly intentions come those that abuse it. Like idiots playing torrent downloaded copies, posting spoilers to the xbox forum sites, uploading youtube videos weeks before said releases. Let alone playiing said illegal downloads & rips on a good console over XBOX-Live?? and now btch & moan that you are in banned...Gimme a break fellas. In my opinion you deserve your ban! These are the ones that ruin it for those that have invested and altered their consoles because good people do protect their investment. Shame that a few rotten apples do spoil the bunch.

If one is to go about getting their copies of games and cheat the market out if its fair share, then thats your business. You bought the console, then keep it under your hat, play on your alternate console off the live service, dont gloat about being the 1st kid on the block to have completed the game, get a tons of achievements on GOW2 before 11/7 or 11/6* I'll get into 11/6 in a moment. I dont condone pirates that sell copies for personal gain and if the ones that are banned that alternate option should be looked into. Depends on how MS decides to persue these jerks or if a simple ban of them and the console id will suffice.

In whatever scripting XBOX is running to catch these people I ask that MS not be so out of the loop and not have a blind eye on how this works two fold...

1. Old school Video game stores (like the ones that sell kung fu dvd's, regular dvd's and get movies early before street dates, 10 dollar cheaper blu-rays & thirts & sneakers & tube socks) that have survived the uprisings of Gamestop/Bestbuy/Circuit City/Target/Wall Mart...you know where Im going with this. Old school places (Get over it Major & crew)..DO get there stuff EARLY they are legit factory sealed titles in the grennery of the XBOX plastic with a clear label across saying do not sell b4 said dates..My Korean king here named KIM has been selling me early release since PS2 days. Check my Madden 09 achievements they dont match the launch date, but its not a ripped copy either.

2. If whats true about people calling in to xbox customer svce and getting rude treatment after a ban, well thats a company decision to make after all the wonderful company that is Xbox hasnt ever tried to decieve us ever huh???? After all that little class action suit really doesnt have no merit, right fellas? right Major?? In this area of the script you are running to catch these people dont bite the hand that feeds you. Do remember people that have sent their consoles in for RROD repair if what I have read on some of the posts also got flagged. This needs to be fixed here so that legit people dont get flagged

Im off to play Gears2 that i have rented from gamefly on my non modded console. Yes thet 360 of mine that drains my paycheck when goodies come out, its a beauty and a subtracter of funds more so of my then wife. But I would never do anything to break my marriage to it..Amen..

As for DLC, Microsoft (or any company dealing in DLC) should have it where you can sell the DLC back or transfer its license to another person. Locking a game to the console, gamertag is awful. Nintendo Wii made me open my eye as their games 'should be' erased when you sell your Wii and you can not reclaim them later and you lose all your Wii Points. How sad.

I love my Xbox360 and I hope not to part with it until 2015 or so.

I somewhat agree with you on the should be able to swap out the Xbox360 HD for any size 2.5 HD. I think it has to do with pirating and game home brew. The 60GB is on amazon, but I first have to get this firewire hub for my PC to get my handycam back online for inputting game video. Today, I'm getting Fallout 3 for $35 used and Wii's Marioware for $15, used from a friend who buys games, beats them and sells them. So, stopping retailers won't stop used game sales. Ebay, now the haven for hard to find games is actually more competition to retail store for used games. I love my 3DO just as much as my Xbox360. My Turbo Duo doesn't get as much love.

I would love it if. Microsoft issued codes that were specific to the disk that would allow the game to be copied to the HD WITHOUT the use of the CD in the tray. Say I purchased Crackdown 2, it takes 7GB to install to my HD. Then an option of Play Without CD, then and there for THAT DISK I can install and play it as an official game. Now, say I forget that game is on my HD and I just throw it with a few games I'm not playing and let a friend borrow the disk, when he or she tries to install the disk, it will let them and even play offline. But as soon as it connects online, the game should lock up and ONLY be allowed to be played WITH the Disk in Drive for that type of loop hole. A message will be displayed telling why it locked up "This game has been previously installed on another Live Account HD. This DISK can only be accessed if the CD is in the tray or the game is released." These codes can ONLY be generated by and unlocked DISK. I guess it would be like the early DIVX DVDs?

Love ya dude, but um... I'm a game collector, BEFORE my Xbox360, I was running wild on eBay and Myspace, I even started my own 3DO club for me an a few people, I have been gone for a while and logged in a few months ago (I hate myspace - too many bogus things - adds, fake friends, etc) and the group has grown with a LOAD of people 14 to 30 praising the 3DO like it is new. But in reality, what they are saying is exactly how I felt when I first bought it. The outdated graphics still are cool. MY point, get rid of used games and a LOAD of gamers won't be able to afford games.
